A Quebec environmental group was in court Wednesday against Swedish manufacturer Northvolt, arguing that the province allowed work to begin on the company's electric vehicle battery plant without proper analysis of the impact on the area's biodiversity.
The Centre québécois du droit de l’environnement began presenting its case in Quebec Superior Court, where it's seeking two injunctions to suspend work on the site of the future $7-billion facility southeast of Montreal.
The group's lawyer presented a number of documents, including one she described as an assessment from a government biologist who said the information provided by Northvolt was insufficient to evaluate the impact on wildlife on the site.
Lawyer Jessica Leblanc said it was "unreasonable" for the province's Environment Department to have authorized Northvolt to begin work on the site because it didn't have enough information on the environmental impacts.
She said the authorization was also given on the condition that Northvolt propose a plan to mitigate the impacts of any biodiversity loss, but that it was given three years to do so.
The project was announced in September by Prime Minister Justin Trudeau and Premier François Legault, with the two levels of government committing billions in financial support.
The provincial Environment Department issued the authorization to begin construction on Jan. 9. As part of the approval, it wrote that in order to mitigate the impact on wildlife habitat, the company "has committed to creating, restoring or conserving natural environments over an area to be determined, which will be of equal ecological value."
Leblanc said there's still no indication of where Northvolt will create new wetlands to compensate for those that will be destroyed to build the facility.
The company had started felling trees on its 170-hectare site, which straddles the municipalities of McMasterville and St-Basile-le-Grand, but it stopped late last week after the injunction request was filed by the environmental group and three citizens.
Marc Bishai, another lawyer with the environmental group, said the group isn't trying to derail the project but rather to ensure the rules are respected.
"We consider that destroying now and protecting later, without having enough information to ensure we control the environmental impacts, we think it's a decision that's certainly questionable," he told reporters.
He said a court victory for his group could result in the project being sent back for study, but he hopes it would not cause too long a delay.
Nathalie-Anne Béliveau, a lawyer for Northvolt, said an injunction that delayed construction would have a devastating effect and could even "be fatal" for the project. She rejected the arguments of the environmental group that there is a risk to wildlife habitat.
Justice David Collier has taken the case under deliberation and work at the site remains suspended. He said he expects to have a decision soon.

It is much, much more than demanding a hearing about the ecological value of over one hundred ha of land, situated in a corridor between Mont-Saint-Hilaire(Gault ecological reserve) and Mont Saint-Bruno. It is about having the «big picture» about how we must transition away from fossil fuels. Northvolt is just one piece of that puzzle. Since Feb. 2023, many groups have demanded «un BAPE générique» in order to make the proper choices to fight climate changes in the coming 21st century; but the government of M Legault is silent.
A few years back, that same land was slated to be a residential project on an abandonned industrial site. That residential project was rejected because it had to have a BAPE(Québec’s environvonmental agency). Now the rules are custom-made and changed behind closed doors to allow Northvolt to use the same land WITHOUT a BAPE hearing. This double standard irritated many.
Besides, there are many practical questions that demand answers. The site is on the shores of the Richelieu River, about 12 km or so from the major highway. (autoroute #20) . How will transportation work???. 3000 or so workers will commute daily through the quiet streets of Beloeil? Ditto for the trucks who will bring in the raw materials to the factory, then drive away with the finished battery cells. Where will these workers live? Can the CNR help with this transportation bottleneck?
Batteries use various chemicals to store electricity. What would happen if there was an accident? What actions will be used reduce such dangers? We are not against this project; but solid answers must be given.
PS We condemn the action where some people sabotaged trees by planting nails and spikes in them ; thereby making them useless if they eventually have to be cut.
In my previous comment, I forgot to mention a second major accident on those sites. In August 1988, a fire destroyed a warehouse in St Basile; that warehouse was filled with 75 000 liters of highly toxic BPC (biphényles polychlorés). A major fire in such dangerous chemicals was a major ecological disaster. see
